JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
Petitioner had accompanied Mantu Sharma @ Bauka aged about 18 years on the pretext of employment about five months ago. As Mantu Sharma @ Bauka did not return to his place, on account thereof, informant, his mother repeatedly approached the petitioner who scolded her.
Though the investigation has been completed but, it is evident that alleged victim, Mantu Sharma @ Bauka is still untraceable.
It has been submitted on behalf of petitioner that the alleged victim was an idiot and on account thereof, he might have slipped during course of coming to his home. It has also been submitted that charge-sheet had already been submitted. It has further been submitted that apprehending some sort of illegal
Patna High Court Cr.Misc. No.8611 of 2016 (3) dt.12-04-2016 activity, petitioner had already filed Sanha against prosecution party. Also submitted that there happens to be inordinate delay. Learned APP opposed the prayer for bail.
For the present, I do not see it a fit case for grant of bail. Prayer for bail is rejected.
