The petitioner has prayed for bail in a case registered for the offence punishable under section 364A of the Indian Penal Code and subsequently Sections 341, 323, 379, 120B/34 of the IPC were added.

Prosecution case relates to kidnapping the informant's father while he had gone to purchase hay by pick-up van to Laskaripur. It is further alleged that informant received a ransom call of Rs. 2 lac from his father's mobile for release of his father and pickup van. Accused persons have also threatened the informant of dire consequences.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is

After recovery of the informant's father his statement was recorded u/s 164 Cr.P.C. wherein he has stated about the complicity of the petitioner in the alleged incident. Similarly situated several co-accused persons have already been granted bail by the learned lower court. Petitioner is languishing in judicial custody since 27.03.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magi9strate 1st Class, Muzaffarpur (West) in connection with Kanti P.S. Case No. 755 of 2021.
