The petitioner seeks bail in a case under section 302 and other sections of the I.P.C.
The informant alleged that some dispute arose due to harvesting of maize crops, and the petitioner is alleged to have assaulted Md.Mustafa with bamboo on his head. Md. Mustafa died during the course of treatment.
Learned counsel for the petitioner submits that the occurrence took place due to land dispute. There is no eye-witness to the occurrence.

Mustafa with bamboo on his head and on account of head injury Md. Mustafa died. Hence, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected. The trial court is directed to expedite and conclude the trial within nine months from the date of receipt of a copy of this order. If the trial is not concluded, the petitioner may renew his prayer for bail firstly in the trial court.
