The petitioner is not named in the first information report but in course of investigation, the petitioner and victim were recovered from a room and after that statement of victim was recorded under section 164 of the Cr.P.C. The victim was medically examined and she was found between 18-19 years of age. The victim stated that she was taken away by the petitioner but her statement reflects that there was some sweet relation between her and the petitioner because the victim, specifically, stated in her statement that petitioner had promised her to solemnize marriage with her but the petitioner did not solemnize
Patna High Court Cr.Misc. No.8697 of 2016 (2) dt.29-02-2016 2/2 marriage with her.
The contention of the petitioner is that, as a matter of fact, the victim, being a major, eloped with the petitioner but when she came in touch of her family members, she tried to twist the entire episode.
Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur in connection with Ujiarpur P.S. case No.194 of 2015.
