Mr. Asif Kalim, learned Advocate for the State, however, points out that in view of the directions given by

Patna High Court MJC No.987 of 2018 dt.20-04-2023 2/2 the Division Bench vide order dated 11.08.2017, the respondent no. 6 has registered the Encroachment Case No. 17 of 2017-18. But, the case could not be taken to its logical conclusion up till now as the encroacher has filed a Title Suit which is still pending consideration before the competent Civil Court.

In that view of the matter, we find that there is substantial compliance of the order passed by the Division Bench of this Court.

We thus are not inclined to keep this petition pending for any further consideration.

As such, the petition is consigned and disposed of accordingly.
