The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code.

Allegedly, while the informant was going to cattle Hat for purchase of cattle by pick up Van, in the way, the miscreants tried to get the vehicle stopped. When the driver of the vehicle

No.32496 of 2020(2) dt.08-12-2020 2/3 did not stop the vehicle, the miscreants opened fire as a result of which, the driver having lost his balance, dashed the vehicle with the tree and fled away. Thereafter, the miscreants came there and looted away Rs. Three lacs from the vehicle and also snatched away Rs. 11000/ and 50000/- from Ayub and Anil Yadav respectively.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 08-02-2016. Charge sheet/Prosecution report in this case has already been submitted. The petitioner is not named in the FIR. His name transpired in this case in course of investigation. He has not been put on test identification parade to ascertain his participation in the alleged occurrence nor there is recovery of any incriminating article from possession of the petitioner. The other co-accuseds with similar allegation have been granted bail vide statement made in paragraph-15 of the main application. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
