While informant and his friend was in a way to their house were intercepted by unknown criminals who on the pretext of firearm looted away their belongings including mobile set, cash, motorcycle, admit card etc.
It has been alleged that looted mobile was recovered from the possession of petitioner and further, on his inculpatory extra judicial confessional statement other coaccused were also apprehended from whose possession other articles were recovered. Petitioner happens to be under custody since 03.04.2015. However, from para-3 of the petition, it is evident that petitioner has got criminal antecedent. In the aforesaid facts and circumstances of the case petitioner, Amar Kumar is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of Sri Amit
Patna High Court Cr.Misc. No.8416 of 2016 (3) dt.11-04-2016 Kumar Sharma, Judicial Magistrate, 1st Class, Munger / successor in office in connection with Tarapur P.S. Case No.19 of 2015, with a condition that one of the bailor shall be a government servant who will file an undertaking that henceforth petitioner will not indulge himself in criminal activity otherwise he will be accountable for such lapse. The learned lower court, before acceptance of bail bond, will properly identify the status of the bailor.
