The petitioner apprehends his arrest in connection with Siwan Muffasil P.S. Case No. 573 of 2018, registered for the of offence punishable under Sections 413, 414, 420 of the Indian Penal Code.

Three accused persons namely Afjal Imam, Sajid Hussain and Danish Raja were apprehended along with stolen motorcycle in course of vehicle checking. The apprehended accused persons disclosed that the aforesaid motorcycle was handed over to them by petitioner promising them to give Rs.5000/- in the case of transporting aforesaid vehicle to Vishal Mega Mart.

Patna High Court CR. MISC. No.31405 of 2019(2) dt.10-05-2019 2/2 It is submitted by the learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious physical possession of the petitioner. There is nothing on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of the apprehended accused persons which has no evidentiary value in the eyes of law. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No. 573 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
