The present petition has been preferred for transfer of Divorce Case No. 12/2018 from the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Sitamarhi on the ground of inconvenience caused to the petitioner in doing needful pairvi in the aforementioned case.

As per the petition, the lady is presently residing with her parents at Sitamarhi having no financial support. Even the husband (opposite party herein) do not give any monthly support till date although he has undertaken to pay the travel expenses for coming to Muzaffarpur.

Learned counsel for the opposite party submits that he

Patna High Court MJC No.1758 of 2018(13) dt.04-07-2023 2/2 resides at Muzaffarpur and as such, the Divorce Case No. 12/2018 was preferred. It is his further submission that he is ready to pay travel expenses.

The petitioner is presently residing with her parents and is not having financial support from the husband and in that view of the matter, this Court deems it fit and proper to transfer the Divorce Case No. 12/2018 from the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Sitamarhi. The MJC No. 1758 of 2018 is allowed.
