Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case instituted for the offences under Sections 302/34, 120(B) of the Indian Penal Code and 27 of the Arms Act.
Prosecution case, in short, is that the accused persons and some unknown shot the informant's brother, namely, Sanjeet Kumar @ Mantun Sah indiscriminately.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.08.2019. Charge sheet has been submitted in this case. There is no allegation of tampering
Patna High Court CR. MISC. No.33618 of 2020(4) dt.22-01-2021 2/2 of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. The petitioner is not named in the F.I.R. His name has come in this case in course of investigation. The allegation of assault is alleged against the other co-accused, who are named in the F.I.R. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Samastipur in connection with S.T. No.547 of 2019 arising out of Tajpur P.S. case No.107 of 2015. (Sudhir Singh, J) Narendra/- U T
