The petitioner is languishing in custody since 02.07.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The accusation is of robbing the Bolero vehicle. The name of the petitioner sprang up on the confession of co-accused Naresh Sahni. Subsequently the petitioner made confession before the police also.
It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner, though the recovery has been made from one Baskat
Patna High Court Cr.Misc. No.3584 of 2015 (02) dt.28-01-2015 2/2 Jha. It is further submitted that the petitioner has not been put on TIP. Statement to that effect has been made in para 15 of the petition.
Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 164 of 2013.
