The petitioner seeks bail in anticipation of his arrest in connection with Forbesganj P. S. Case No. 1121 of 2019 dated 01.12.2019, instituted for the offences under Sections 341, 323, 379, 504, 406, 420 and 34 of the Indian Penal Code.

The subject F.I.R. has been filed on the basis of a complaint alleging that the informant had deposited Rs. 21,000/- in "Vishwamitra Company" in the hope of getting 20 % interest at the time of maturity. Neither

Patna High Court CR. MISC. No.32436 of 2020(2) dt.10-02-2021 2/3 the principal amount nor the interest on such amount was paid to the informant even after the maturity of the certificate which was granted to her at the time of deposit of money.

The learned counsel for the petitioner has submitted that the complainant / informant has chosen to implicate the wrong person. The petitioner, as an unemployed youth, had joined "Vishwamitra Company" in the hope of earning his livelihood. There is no accusation in the F.I.R. that the money which was given by the informant to the petitioner for depositing it in "Vishwamitra Company" was swindled by him. If the company has not returned the principal amount along with interest to the informant, the petitioner cannot be blamed for the same as he too has been a sufferer as he has not received any salary for the work which he has done for the Company.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on

Patna High Court CR. MISC. No.32436 of 2020(2) dt.10-02-2021 3/3 bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ararai, in connection with Forbesganj P. S. Case No. 1121 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
