This Writ petition has been filed for directing the respondents to issue a writ of Mandamus commanding the official respondent authorities to demarcate and hand over possession of the respective lands of petitioners, allotted to them within the provisions of Privileged Persons Homestead Tenancy Act by way of their respective Basgit Parchas for construction of their houses by them and to give protections to them also from the illegal interference of private respondent and his associates over their respective said lands and also to issue a writ of prohibition restraining the private respondent not to interfere, in any way, in the possession of petitioners over their respective lands in question allotted to them by way Basgit Parchas by competent authorities for construction of their respective houses and not to disposes them from their said settle lands by use of force and in illegal, arbitrary and without jurisdiction manner.
3 . It is submitted on behalf of the petitioner that applications and reminders dated 24.01.2023 i.e, Annexure- 2 (series) of the petition , were duly received in the office of the learned Circle Officer, Sisawn, but till date no step has been taken in this regard.
4. In view of the aforesaid submission, the writ
Patna High Court CWJC No.8036 of 2023(2) dt.24-11-2023 3/3 petition is disposed of in light of Annexure 2 (series) of this writ petition.
3. Let respondent No. 6, (the Circle Officer, Sisawn Circle Office, At-P.O. and P.S., Sisawn, District Siwan) to dispose of the application and reminders of the petitioners dated 24.01.2023 i.e, Annexure- 2 (series) of the writ petition , in accordance with law after hearing all the parties, preferably within a further period of six months from the date of receipt of the copy of this order.
