JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Hussainganj (M.H. Nagar) P.S. Case No. 41 of 2019, disclosing offences under Sections 272, 273, 420 and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Police on information that some persons are engaged in liquor trade, raided their houses and recovery of illicit liquor was made and it is alleged that from the house of this petitioner 2 liters of country made liquor was recovered. Submission of learned counsel for the petitioner is that petitioner is a lady and she has no criminal antecedent and has falsely been implicated in this case. Further submission is that the husband of the petitioner has not been made accused in this case and further the copy of seizure list has not been handed

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cumSpecial Judge, Excise, Siwan, in connection with Hussainganj (M.H. Nagar) P.S. Case No. 41 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
