2. The accused/petitioner seeks bail in connection with Muzaffarpur (Town) P.S. Case No.667 of 2025 registered for the offences punishable under Sections 140(1) of the Bharatiya Nyaya Sanhita, 2023 (for short 'B.N.S.').

3. The accused/petitioner is named in the FIR and is in custody since 08.12.2025.

4. As per FIR, one Nashim parveen alleged that her husband, namely, Sabbir Ansari went to a hotel for taking meal but did not return. It is further alleged that on 07.12.2025, a call was made from informant's husband mobile demanding Rs.

Patna High Court CR. MISC. No.34408 of 2026(3) dt.17-07-2026 2/3 10 lakh, and also before two days, an extortion demand was made for Rs. 17 lakh.

5. It is submitted by learned counsel for the petitioner that as per the victim, the three persons were involved in his kidnapping i.e. co-accused, Md. Dildar Hussain, Md. Sahbaj, Md. Sohail, who were granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 33177 of 2026. It is submitted that husband of the informant has executed a sale deed and had sold a land of somebody else to co-accused persons for which a panchayati was taken place and the husband of the informant has undertaken to pay Rs. 10 lakh and for that purpose he was called for negotiation. It is submitted that during the said negotiation Rs. 1.5 lakh was asked to keep by this petitioner and the petitioner kept said amount out of acquaintance and for that simple reason, he was implicated with the present crime in question.

It submitted that the moment he came to know that the amount which was kept with him was disputed, he deposited the same with police.

Patna High Court CR. MISC. No.34408 of 2026(3) dt.17-07-2026 3/3 with the evidence. Petitioner claimed clean antecedent.

6. Learned APP opposed the prayer for grant of bail to the petitioner.

In view of aforesaid factual submissions and by taking note of fact as allegation of kidnapping is not available against this petitioner coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 08.12.2025 accordingly, the petitioner, abovenamed, who is a man of clean antecedent, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur (Town) P.S. Case No.667 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita (for short 'BNSS').
