Admittedly, in the present case, three persons sustained injuries and out of the aforesaid persons, only one person, namely Akhtar Hussain sustained grievous injury on his head and it is the case of the prosecution that author of the aforesaid injury of Akhtar Hussain are co-accused Rus Mohammad and Fojdar Mian who are not the petitioners.

So far as present petitioners are concerned, they assaulted other two injured who sustained simple injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners be released

Patna High Court Cr.Misc. No.3114 of 2015 (2) dt.23-01-2015 on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in Turkaulia (Banhariya) P.S. Case no. 407/2014.
