The petitioner seeks bail in connection with Mithanpura P.S. Case No.284 of 2015 registered under Sections 419, 420, 467, 471 and 120(B)/34 of the Indian Penal Code. The accusation against the petitioner is that he was selected on the post of Constable in B.M.P. by the Selection Board but, later on, on inquiry, the thumb impression, handwriting and signature of the petitioner were found different in the answer-sheet with the originals.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in
Patna High Court Cr.Misc. No.9175 of 2016 (2) dt.29-03-2016 2/2 custody since 19.10.2015. Further submission is that after investigation, the police has submitted charge-sheet against the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, East Muzaffarpur, in connection with Mithanpura (Muzaffarpur) P.S. Case No.284 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
