JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-02-2021 Heard Mr. Ram Sumiran Rai, learned counsel for the petitioner and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Dandari P. S. Case No. 45 of 2020, dated 16.04.2020 (G.R. No. 1090 of 2020), instituted for the offences under Sections 341, 323,

Patna High Court CR. MISC. No.32438 of 2020(2) dt.10-02-2021 2/3 307, 504 and 34 of the Indian Penal Code.

The petitioners are stated to have assaulted the family members of the informant because of a dispute which arose because the informant had protested against a tractor being driven from near his house. The petitioners are alleged to have caused simple injuries on Umesh Yadav and Sadan Kumar. One Nitish Kumar has received grievous injuries but that is attributable to Pappu Yadav and not the petitioners.

Regard being had to the nature of accusation, the background facts and the availability of the counter version of the occurrence, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class,
