JUSTICE AMARESH KUMAR LAL ORAL ORDER 12-03-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. On the recovery of a dead body, the FIR was lodged against unknown. During investigation, it was located that it was the dead body of Mukesh Ram.

It is submitted that on 3.04.2014 while Mukesh Ram was going to the house of his sister Savita Devi to attend Chhathi of her baby by Patna Bhabua Intercity Train talked by mobile phone and told her that he was travelling with the co-villagers Mantu Kumar and Chandravansh Ram @ Tappu. Thereafter, the mobile of the deceased was switched of. It is further submitted that name of the petitioners has appeared during investigation. The co-accused Chandravansh Ram @ Tappu with whom the deceased was travelling and was last located has

Patna High Court Cr.Misc. No.2441 of 2015 (3) dt.12-03-2015 2/2 been granted bail vide Cr. Misc. No.698/2015. The petitioners are in custody having no criminal antecedent.

Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sri A.P. Choudhary, Judicial Magistrate-1st Class, Rohtas as Sasaram in Chenari P.S. Case No.53/2014 with the following conditions :

1.

One of the bailors will be the close relative of the petitioners.

2.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
