The petitioner seeks bail in Sessions Trial No 69 of 2017 arising out of Kanti Police Station (for brevity PS) Case No 381 of 2015 dated 18.08.2015 instituted for the offence punishable under Sections 302, 120B of Indian Penal Code and Section 27 of Arms Act.

Prayer for bail of petitioner was earlier rejected twice by this Court under order dated 18.07.2016 passed in Cr Misc No 24617 of 2016 and under order dated 05.07.2017 passed in Cr Misc No 20736 of 2017 (Annexure 1 series). The petitioner is stated to be the main assailant having

Patna High Court CR. MISC. No.36578 of 2020(4) dt.12-03-2021 2/2 fired upon temple of the deceased by close range. Considering the period of custody, this Court called for the report regarding the stage of trial. Report states that 11 witnesses have already been examined and informant and Investigating Officer (for brevity, IO) are the only witnesses remained to be examined.

In view of the aforesaid circumstances, this Court would observe that the trial should be taken to its logical conclusion very soon.

Prayer for bail is again rejected for the present. This order should be brought to the notice of Superintendent of Police of the concerned district to ensure that the IO appears at the trial.
