There was commission of dacoity in the house of informant, Prabhu Prasad and during course thereof, the dacoits looted away his belongings. Dacoits have also hurled bomb. Furthermore, informant had claimed identification of his covillager, Naresh Mandal perceiving his voice. From the order impugned, it is apparent that petitioner's presence has been effected on an inculpatory extra judicial confessional statement of Naresh Yadav save and except the aforesaid material, nothing substantive even to the extent of conduction of T.I. Parade, is found during course of investigation.
Accordingly, petitioner Bimlendu Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.2245 of 2015 (5) dt.08-05-2015 (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Ad-hoc Additional Sessions Judge, IInd, Sitamarhi in connection with Sessions Trial No.150 of 2014 arising out of Bathnaha P.S.
