2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Mahila P.S. Nalanda Case No.21 of 2026 registered under Sections 64(1), 126(2), 115(2), 352 and 351(1) of the Bharatiya Nyaya Sanhita, 2023 (in short 'BNS').
3. As per FIR, petitioner alleged to commit rape upon informant on different occasions for a continuous period of three years, who is none but the maternal aunty of the petitioner.

4. It is submitted by learned counsel appearing for the petitioner that the petitioner was implicated falsely with present case. It is further submitted that, as per FIR, the victim made an attempt to commit suicide on 23.01.2026, after consuming poison but the FIR in issue was lodged on 21.02.2026 and this delay was not explained by the informant while authoring the FIR. It is also submitted that the physical relationship was alleged to established under the threat of making video viral having objectionable scene to the husband of the informant and other family members, but no such video clips were recovered during investigation either from the husband of the informant to whom it was alleged to sent and also from any other persons.
It is further submitted that the factual aspects categorically suggest that no such video clips was ever recovered, making entire allegation doubtful. Arguing further, it is submitted that the informant is 50 years old lady, whereas the petitioner is 33 years old and therefore, the implications is not appears convincing, particularly in view of the relations of the parties also.
3/4 the petitioner on the instance of husband of the informant. Explaining criminal antecedent, it is submitted that petitioner found involved in one more criminal case related with theft, where he is on bail.

Learned APP duly assisted by the learned counsel for the informant, Mr. Pankaj Kumar, while opposing the prayer of bail submitted that the petitioner himself filed informatory petitions on 27.01.2026 under Section 33 of the BNSS, before the court of learned C.J.M., where he admitted that the informant consumed poison on 24.01.2026. It is further submitted that the matter was initially pending with Mahila Helpline, where petitioner also appeared on 18.02.2026 and only thereafter, the FIR in issue was registered on 21.02.2026. It is further submitted that the scientific evidence collected during the course of investigation suggest that this petitioner sent objectionable nude photo of informant to her husband and other family members, whereafter only, the informant made an attempt to commit suicide.
6. In view of aforesaid factual submissions and by taking note of the fact as this is not a case where physical relationship appears established on the basis of any deceitful
4/4 means under false pretext of marriage rather it appears established under the threat of blackmailing to the informant, where the petitioner also appears to admit consuming poison by informant almost on same day as alleged by informant, accordingly, the prayer of anticipatory bail of the petitioner stands rejected.
