JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Ramgarh (Nuaon) P.S. Case No. 163 of 2014 registered for the offence punishable under Section 379 of the Indian Penal Code. Allegedly, motorcycle of the informant was stolen away by unknown thief. During investigation, the said motorcycle was recovered from the house of the petitioner kept in the room where she-goats are kept.

Submission is of false implication, nothing has been recovered from the conscious possession of the petitioner, the petitioner has got no criminal antecedent and is suffering in custody since 01.01.2016.

Patna High Court Cr.Misc. No.12171 of 2016 (3) dt.03-05-2016 Learned A.P.P. opposes the prayer of bail.

In the facts and circumstances stated above, the petitioner shall be released on bail after completion of 6 (six) months in custody from date of his remand on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhabua, in connection with Ramgarh (Nuaon) P.S. Case No.163 of 2014, subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
