Mr. A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-12-2020 Heard the learned counsel for the petitioner, informant and the State.
The petitioners seek bail in connection with Kalyanpur P.S. Case No. 70 of 2020 instituted for the offences under Sections 341, 323, 307, 34, 324, 302, 447 and 504 of the Indian Penal Code.
The petitioners and others are said to have assaulted the two sons of the informant when they had come in protest against the aggressive behaviour of the petitioners and others.
One of the sons of the informant died because of the injuries suffered by him.
Learned counsel for the petitioners submits that the petitioners are the agnates of the informant and the
Patna High Court CR. MISC. No.33436 of 2020(2) dt.15-12-2020 2/2 deceased and there is a pending land dispute between them. There is a counter version of the occurrence also and that other persons also are said to have assaulted the deceased along with the petitioners.
The petitioners are stated to be in custody since 16.04.2020.
Notwithstanding the aforestated arguments, I am not inclined to grant bail to the petitioners for the present.
Accordingly, the prayer for bail is rejected. However, the petitioners would be at liberty to renew their prayer for bail, if there is no substantial progress in trial within nine months from today. (Ashutosh Kumar, J) krishna/- U T
