In this case the petitioner is seeking bail in S.Tr.No.740/15 arising out of Kadirganj P.S.Case No.38/15 for the offences under Sections 147,148, 149 and 302 of the I.P.C. As per allegation ten persons armed with different weapons forcibly took away Mahesh Bind, father of the informant, and mercilessly assaulted him and on that account he succumbed to his injuries.

The counsel for the petitioner submits that nobody has seen the occurrence. In the whole of the case diary all the witnesses have made sweeping and omnibus statement without any basis. Both sides are on inimical term from before. He further

Patna High Court Cr.Misc. No.7334 of 2016 (4) dt.12-04-2016 2/2 submits that co-accused, Akhilesh Bind and Umesh Bind have already been granted anticipatory bail vide order dated 8.4.2016 passed in Cr.Misc. No.13470/16.

In such view of the matter, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.D.J.,IV, Patna, in S.Tr.No.740/15 arising out of Kadir Ganj P.S.Case No.38/15.
