2. The petitioners seek bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..
3. The prosecution case, in brief, is that on 04.08.2024, daughter of informant, namely Shivani Kumari, went towards the D.J. being played in a marriage event but she did not return. It is alleged that despite search, the victim could not be traced. Thereafter, on 06.08.2024, dead body of daughter of informant was found in mutilated condition. Informant
Patna High Court CR. MISC. No.32494 of 2025(2) dt.18-07-2025 2/3 suspects that all the F.I.R. named accused persons, including this petitioner and some unknown persons, committed rape and murder of his daughter.
4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that informant is not an eye witness of the occurrence and only suspicion has been raised against these petitioners. It is further submitted that in the post mortem report, no external injury was found on the body of the deceased and the dead body was recovered from an open place. Moreover, charge-sheet has already been submitted and petitioners are in custody since 23.08.2024. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the nature of accusation, period of custody and clean antecedents of the petitioners, the prayer for grant bail of to the petitioners is allowed.
7. Accordingly, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with
