JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.01.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. 4 kgs ganja is said to have been recovered from the house of the petitioner and at the time of recovery, petitioner was caught in his house. Admittedly, he is in jail custody from the date of his custody i.e. since 04.11.2014. The contention on behalf of the petitioner is that petitioner is student of charter accountancy and, as a matter of fact, he was not aware of the recovered ganja and furthermore, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be
