JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 4.8.2014 in Korha P.S. Case No.134/14 for the offence under section 304 (B)/34 of the I.P.C. and 3⁄4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the marriage of sister of the informant was solemnized with the petitioner in the month of January, 2014 and after some time the accused persons including the petitioner used to torture and assault for a motorcycle and on 1.8.2014 on account of non-fulfillment of the dowry demand she was killed by them.

It has been submitted on behalf of the petitioner that he is in custody since 4.8.2014, Charge sheet has been submitted

Patna High Court Cr.Misc. No.3090 of 2015 (7) dt.29-07-2015 2/2 in the case. He has falsely been implicated in the present case. On behalf of the State it has been submitted that the petitioner is named in the F.I.R. who is husband of the deceased. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected.

However, the trial court is directed to expedite the trial and conclude the same within six months from the date of receipt/production of a copy of this order.
