JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2020 The petitioner seeks bail in connection with C-1 Case No. 151 of 2020, which has been instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that 270 litres of foreign liquor and 120 bottles of bear were recovered from the vehicle belonging to the petitioner.

It has been pleaded in the bail application that the petitioner is the owner of the said vehicle, but on the date and time of the recovery, the vehicle was being driven by another person against the clear instruction of the petitioner,

Patna High Court CR. MISC. No.33422 of 2020(2) dt.14-12-2020 2/2 not to use the same for any illegal purposes. The petitioner is stated to be in custody since 17.08.2020 and claims to be a person of clean antecedent. Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Purnea in connection with C-1 Case No. 151 of 2020.
