The petitioners apprehend their arrest in connection with Majhauliya P.S. Case No.278 of 2020, registered for the offence under Sections 341, 323, 324, 325, 307, 354 and 34 of the Indian Penal Code.
Prosecution case in short is that, when the informant was sitting at his door co-accused persons including the petitioners are abusing the informant and on protest they started abusing him due to previous land dispute. Co-accused Parshuram Singh inflicted farsa blow over head of Subhash Patel due to which he sustained injury and fell on the ground. The accused Ravi Ranjan Singh assaulted to Sunil Patel with iron rod over his head, Budhan Singh gave farsa blow over the head of informant, other co-accused snatched
Patna High Court CR. MISC. No.44526 of 2021(2) dt.23-03-2022 2/2 Rs.10,000/- from the cash box kept in the shop of Sunil Patel, snatched golden chain of Shnati Devi and they also tore her clothes. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to land dispute. He further submits that the injuries are simple in nature and there is no repetition of blow. Learned counsel appearing on behalf of the petitioners submits that there is general and omnibus allegation against the petitioners. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, is directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No.278 of 2020, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
