JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be driver of the vehicle from which in huge quantity Mahua flower was recovered but submission on behalf of the petitioner is that petitioner is in jail custody since 18.01.2016 and prior to institution of the present case, no case for the offence under Excise Act had been registered against the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad ( Town) P.S.Case no.25 of 2016.
