JUSTICE HARISH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 24-06-2024 The petitioner is aggrieved with his disqualification in a tender he applied under Annexure-P/1. Annexure-P/1 has a condition that the statement of the bank account for last six months preceding the publication of the Tender Call Notice submitted, should be duly attested by the Branch Manager of the bank with signature & seal.

2. The petitioner has submitted Annexure-P/3 bank statement, which contains the round seal of the bank and a signature without any specification as to the designation of the signatory. We notice that the specific condition in the Notice Inviting Tender is that the account statement should be attested by the Branch Manager with the signature and seal. Hence there should be the round seal of the bank and also the seal indicating the designation of the signatory.

3. In a similar matter with respect to the very same NIT we have rejected the identical contention raised by another tenderer in CWJC No. 6560 of 2024 by judgment dated 22.04.2024. We find absolutely no reason to defer from the earlier judgment.
