The petitioner being the husband of the complainant is languishing in custody since 29.11.2014 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 494, 323 of the Indian Penal Code and 4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand and performing second marriage. Earlier the petitioner was granted anticipatory bail on readiness to make payment of Rs.1,500/- to the complainant from May, 2012 when the issue could not be
Patna High Court Cr.Misc. No.4820 of 2015 (03) dt.13-05-2015 2/2 reconciled since the petitioner already performed second marriage. The petitioner fails to make payment and subsequently bail bond of the petitioner was cancelled as per the stipulation make in the anticipatory bail order.
Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 1517(C) of 2011.
