JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and five others were caught when they had assembled to make preparation for committing dacoity and in course of search, one loaded country made pistol and a mobile phone were recovered from conscious possession of the petitioner whereas firearms and other articles were recovered from the possession of other accused persons.
The contention on behalf of the petitioner is that for recovery of firearm, a separate case, i.e., Jokihat P.S.Case No. 319 of 2015, and for preparation for committing dacoity, a separate case, i.e., Jokihat P.S.Case No. 318 of 2015, were registered and so far as the present case is concerned, the same
Patna High Court Cr.Misc. No.7932 of 2016 (2) dt.19-02-2016 2/2 was registered for preparation of so called forged documents. It is further submitted that having more or less similar allegation, one co-accused, namely, Md. Pintoo @ Md. Mantoo has already been granted privilege of bail by this Court.
No doubt, petitioner carries criminal antecedent but taking note of the aforesaid facts and circumstances as well as submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Araria in connection with Jokihat P.S.Case No. 320 of 2015, G.R.
