The petitioner seeks bail in anticipation of his arrest in connection with Magadh Medical P.S. Case No. 21 of 2020 instituted for the offence under Sections 379/34 of the Indian Penal Code and Section 21 of Mines and Minerals (Development and Regulation) Act, 1957.

It appears that the vehicle in question was seized by the Mines Inspector, as it was being used for transporting illegally extracted sand.

Learned counsel for the petitioner submits that he

Patna High Court CR. MISC. No.26478 of 2020(2) dt.21-10-2020 2/2 is the owner of the vehicle in question and driver of the vehicle despite the instructions of the petitioner, had played truant and had used the vehicle for transporting sand. Considering the nature of accusation against the petitioner and the fact that the petitioner had taken all the precautions that his vehicle should not be misused as well as the fact that he has no criminal antecedent, he is is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Gaya, in connection with Magadh Medical P.S. Case No. 21 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
