JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, the present case was lodged against unknown but in course of investigation, the statement of informant was recorded under Section 164 of the Cr.P.C. in which she disclosed that prior to the alleged occurrence, the younger brother of the petitioner had misbehaved with her daughter and when her husband made complain, petitioner and his other family members had given threatening of dire consequences to him. Learned counsel for the petitioner submits that except the above stated suspicion, there appears to be nothing against the petitioner and moreover, having more or less similar allegation, co-accused, Arjun Mandal @ Arjun Mahton, who happens to be

Patna High Court Cr.Misc. No.7349 of 2016 (3) dt.24-02-2016 2/2 father of the petitioner, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha P.S. Case No. 06 of 2015.
