The petitioners are languishing in custody since 24.09.2014 and 26.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 325 and 506 of the Indian Penal Code. Subsequently section 302 of the IPC was also added.
It is alleged that 10 FIR named accused persons including the petitioners came started assaulting with lathi and pelted bricks on the family of the informant. Narayan Bind
Patna High Court Cr.Misc. No.3588 of 2015 (02) dt.28-01-2015 2/2 subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioners that the injury report of Narayan Bind suggests one lacerated and one swelling wounds on the parietal region. Considering the fact that the accusation is omnibus and general and there is counter version of the occurrence also, petitioners' side have also received injury and statement in para 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 241 of 2014.
