The petitioner seeks regular bail in a case registered under Sections 395 and 412/120B of the Indian Penal Code. The informant lodged a case against eight unknown accused persons for looting of his truck.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Name of the petitioner figured in the case in the confessional statement of co-accused Suresh Sah. It is said that the petitioner was the driver of the pick-up-van of one Mohan Sah, who carried the looted article to the godown, but nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 19.12.2014, but the petitioner has not been put on Test Identification Parade as yet.
Patna High Court Cr.Misc. No.3118 of 2015 (2) dt.22-01-2015 2/2 Considering the facts that neither the petitioner has been named in the F.I.R. nor anything was recovered from his possession and that the petitioner has not been put on T.I.P as yet, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Kumar Singh, Judicial Magistrate 1st Class, Samastipur in N.H. Bangra P.S. Case No. 93 of 2014.
