The petitioner apprehends her arrest in a case registered for the offence under Sections 420, 467, 468, 471/34 of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act.

Allegation against the petitioner is that she made construction over the land of Housing Board.

It is submitted on behalf of petitioner that petitioner is lady and she is residing abroad and there is no eye-witness of the occurrence to the effect that anyone has seen this petitioner on spot. It is further submitted that co-accused namely Awadhesh Kumar has been granted anticipatory bail by this Court, vide order dated 18.08.2017 passed in Cr.Misc. No. 36697 of 2017.

No.44174 of 2021(3) dt.04-07-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is named in F.I.R. and has approached this Court after a lapse of five years of the occurrence and there is no explanation for this delay. Considering the nature of accusation and delay in approaching this Court, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
