JUSTICE BIRENDRA KUMAR ORAL JUDGMENT Date : 29-01-2019 This miscellaneous appeal, under Order XLIII Rule1(r) of the Code of Civil Procedure, has been preferred against the order dated 09.02.2017 passed by learned Sub Judge-XI, Muzaffarpur, in Partition Suit No. 541 of 2016.

2. The learned Court-below has refused the prayer for ad interim injunction to the plaintiff-appellants.

3. Heard learned counsel for the appellants and have gone through the impugned order and merit of the case. No case of ad interim injunction is made out in a partition suit where there is unity of title and possession.

4. There is no need to emphasize that any development on the joint family property by any of the cosharer by construction etc. would be subject to the result of the suit and likewise any encumbrance or transfer of property would also be subject to the result of the suit.

5. Learned court-below is directed to expedite the disposal of partition suit and dispose of the same preferably within six months without allowing any unnecessary adjournment to any of the parties.
