JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-12-2024 Vide impugned order dated 06.10.2020, the President, Bihar State Board of Religious Trust has decided the nature of the trust in question, and he declared it to be a public trust.

2. Learned counsel for the petitioner has submitted that, in subsequent meetings of the Board dated 16.01.2021, the 81 decisions taken by the President were confirmed by the Board but the details of those 81 decisions were not given in the resolution of the Board.

3. Be that as it may, Section 28(2)(u) of Bihar Hindu

Patna High Court CWJC No.13804 of 2021(14) dt.03-12-2024 2/2 Religious Trusts Act, 1950 makes a provision that the Board is empowered to decide the nature whether a trust is public or private and the aggrieved/interested person may challenge the order of the Board before the competent Court.

4. The petitioner may raise his grievance before the competent court and if he raises his grievance within a period of four weeks, the competent Court shall finally adjudicate it as early as possible.

5. With these observations, this writ petition stands disposed of.
