The petitioner seeks bail in Sarsi P.S. Case No. 83 of 2020, registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence while the informant was going to Gulabbagh Mandi with tractor and tailor and reached at Barjhara more, three miscreants riding on two motorcycle overtook the tractor. On the point of pistol tied his mouth and hands and snatched his mobile and got seated him on motorcycle. One miscreant took away the tractor.

It is submitted on behalf of the petitioner that petitioner is neither apprehended on the spot nor not named in the FIR. No looted article has been recovered from possession

Patna High Court CR. MISC. No.44034 of 2021(2) dt.01-11-2021 2/2 of this petitioner. Name of petitioner transpired in this case on the disclosure of co-accused Ajay Das. No test identification parade has been held till date. Petitioner is in custody since 11.02.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Purnea in connection with Sarsi P.S. Case No. 83 of 2020.
