The petitioner is accused in connection with Bihpur P.S. Case No. 259 of 2015, registered under Sections 394, 302, 120(B)/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the deceased is the mother-in-law of the petitioner and the informant, namely, Bandana Kumari is his wife. In course of investigation, after three months, the Police got recorded the confessional statement of Md. Phool, who disclosed the name of the petitioner being the conspirator in the murder of his mother-in-law (deceased), except that there is nothing against the petitioner. The petitioner having no criminal antecedent is in custody since 23.12.2015.
