JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 24-08-2023 Heard Mr. Ashok Kumar Singh, learned counsel appearing on behalf of the petitioner; Ms. Archana Meenakshee, learned GP-6 appearing on behalf of the State and Mr. Binod Kumar Labh, learned counsel appearing on behalf of the Accountant General.

2. Learned counsel appearing on behalf of the petitioner informs that all steps have been taken by the Sanctioning Authority and sanction letter contained in Memo No. 917 of 13.06.2023 has already been issued to the Accountant General, Bihar. He further submits that other

Patna High Court CWJC No.8035 of 2023 dt.24-08-2023 2/3 retiral dues has already been paid to the petitioner on 13.06.2023.

Mr. Binod Kumar Labh, learned counsel appearing on behalf of the Accountant General, Bihar, has submitted that he will communicate to the Accountant General, Bihar for taking immediate steps to fix the pension of the petitioner and send a copy of authority slip to the Treasury Officer, Nalanda forthwith so that the petitioner may not suffer further in getting his due amount of pension and gratuity.

Considering the aforesaid submission made on behalf of the rival parties as well as the counter affidavit filed on behalf of the State, the Accountant General, Bihar is directed to take immediate steps by directing the concerned officer under his jurisdiction to fix the pension of the petitioner and other dues payable to the petitioner in accordance with law within a period of three weeks and communicate the same by sending the authority letter to the Treasury Officer, Nalanda within the aforesaid period.

5. The Treasury Officer, Nalanda, is directed to forthwith credit the entire amount into the pensionary account of the petitioner lying in the concerned bank.

6. In case the petitioner finds that further delay is caused by any of the authority, he may take appropriate legal action against the concerned authority.

7. With the above observation and direction, the present writ petition stands disposed of.
