2. The petitioner seeks bail in connection with Barari P.S. Case No. 15 of 2025 registered for the offence under Sections 25(1-b) (a) and 26 of the Arms Act.
3. The petitioner is named in the F.I.R. and is in custody since 15.01.2025.
4. The allegation as per FIR is that petitioner was found in possession of one loaded country made pistol.
5. Learned counsel appearing on behalf of the petitioner submitted that the alleged recovery of the loaded country made pistol was not made from the conscious possession of the petitioner. It is pointed out that the seizure list is even not supported by the independent witnesses, rather by the police personnels therefore, false implications cannot be

While concluding the argument, it is submitted that petitioner was found involved in three criminal cases in which he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP, opposed the prayer of bail.

In view of aforesaid facts and submission as mentioned above, as seizure list is not supported by the independent witnesses rather by the police personnels, coupled with fact that investigation of this case is completed, chargesheet has already been submitted where petitioner is in custody since 15.01.2025, accordingly petitioner above named, is directed to be released on bail in connection with Barari P.S. Case No. 15 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, subject to the conditions as mentioned under Section 480(3) of BNSS.
