The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Excise Act and Sections 25 (1-b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has antecedent of one case and informant alleges that 8 liters of liquor along with a pistol was found from the semiconstructed house of the petitioner. Learned counsel for the petitioner submits that the petitioner was not apprehended from the spot as such nothing was recovered from his conscious possession, it is next submitted that the house is semi-constructed and as such, no one was living in the house.

Patna High Court CR. MISC. No.34582 of 2023(2) dt.20-06-2023 2/2 Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the house belongs to the petitioner which is not in dispute and a pistol was also found from the semi-constructed house of the petitioner which further demonstrates that the petitioner had concealed the arms in the said house.

Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
