The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Recovery of country-made liquor is alleged from the river-side. However, it is stated that the same was of the petitioner. The petitioner has got identical criminal antecedents. The petitioner is in custody since 16.06.2020. Considering the lack of material against the petitioner in this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection

Patna High Court CR. MISC. No.34180 of 2020(3) dt.11-01-2021 2/2 with Sirdala P.S. Case No.499 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) If the Court-below would come to notice that petitioner has committed identical offence that would be a ground for cancellation of bail by the Court-below in this case also.
