Petitioner is languishing in custody since 18.09.2015 in a case registered for the offences punishable under Section 399, 402/34 of the Indian Penal Code, 25(1B)a, 26(ii). 35 of the Arms Act and 20, 22 of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that from the possession of the petitioner two disposable syringes, Ativan sedative tablets and mobiles were recovered.

It is submitted by the learned counsel for the petitioner that recovery does not suggest that the petitioner was involved in committing dacoity. Only on suspicion accusation has been levelled and similarly situated accused Mahesh Roy and Chandan Kumar have been granted bail vide Cr. Misc. No. 54150 of 2015 and Cr. Misc. No. 49710 of 2015. Though, the

Patna High Court Cr.Misc. No.8875 of 2016 (2) dt.23-02-2016 petitioner is accused in one other case under Section 392 of the Indian Penal Code, in which he is on bail. Investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VII, Muzaffarpur in connection with Maniyari P.S. Case No. 206 of 2015.
