The petitioner is languishing in custody since 28.01.2019 in a case registered for the offences punishable under Sections 461 and 379/411 of the Indian Penal Code. It is alleged that the petitioner was apprehended with stolen a bicycle.

It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner was apprehended with a stolen bicycle.

Considering the nature of accusation and the fact that the investigation has already been concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner

No.34346 of 2019(2) dt.27-05-2019 2/2 is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Danapur, Patna in connection with Shahpur P.S. Case No. 34 of 2019.
