JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Neither petitioner was caught at the spot nor anything was recovered from his conscious possession and it appears from the submissions as well as impugned order of learned Additional Sessions Judge that petitioner has been made accused in this case only on the basis of his criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Rail Judicial Magistrate, Katihar in connection with Katihar Rail P.S.Case No. 33 of 2014.
